Terms and Conditions

Welcome to PawFitter. These Terms and Conditions ("Terms") govern your access to and use of the PawFitter mobile application ("App"), including any content, functionality, services, and products offered on or through the App. The App is operated by Tosh LLC ("Company," "we," "our," or "us").

Please read these Terms carefully before using the App. By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

1. Description of Services

PawFitter provides artificial intelligence (AI) services for pets, including breed identification, size-fitting, and virtual try-on tools. The App also includes navigational links to an external Shopify store allowing users to purchase merchandise and custom wall art, and features links to third-party products as an Amazon Affiliate.

2. Eligibility and Age Restrictions

By using the App, you represent and warrant that you are at least 18 years of age or the age of majority in your jurisdiction. If you are under 18, you may only use the App with the consent and supervision of a parent or legal guardian.

In compliance with Google Play Store Policies regarding child safety, this App is not intentionally targeted toward children under the age of 13. We do not knowingly collect personal data from children under 13.

3. Account Registration and Mandatory Deletion

To access certain features of the App, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your account password.

• Account and Data Deletion: In compliance with Google Play Store data safety requirements, you have the right to delete your account and all associated personal data at any time. You can initiate a deletion request directly within the App's settings menu or by visiting our dedicated web deletion request page at [Insert Deletion Link/URL]. Upon request, all personal data, including uploaded pet photos and account information, will be permanently removed from our servers unless retention is legally required.

4. AI Breed Identification, Size Fitting, and Generative Content Safety

To use our AI features, you may upload photos of your pet ("User Content") to generate simulated sizing, virtual try-on previews, and breed identification results ("AI Output").

• No Guarantees: Our AI features—including breed identification, size-fitting, and visual try-ons—are predictive analysis and simulation tools. We do not guarantee 100% accuracy regarding pet breed determination, exact dimensions, sizing fit, or visual representations.
• Prohibition of Explicit & Prohibited AI Content: You are strictly prohibited from uploading content or attempting to manipulate the App’s AI features to create, generate, or distribute material that is sexually explicit, pornographic, gratuitously violent, defamatory, hateful, or abusive. You may not use our AI tools to create deceptive content, deepfakes, or imagery that infringes on the intellectual property or privacy rights of any third party.
• UGC and AI Safety Enforcement: Tosh LLC maintains a zero-tolerance policy against objectionable content and abusive users. In compliance with Google Play Store Developer Policies for Generative AI, we implement robust content filtering, automated screening, and reporting mechanisms. Users have the functional ability to flag or report explicit content, offensive AI outputs, or policy violations directly inside the App interface. We reserve the right to review, flag, block, or permanently delete any User Content or AI Output, and to immediately terminate the account of any user violating these safety standards.

5. Shopify E-Commerce Store and External Checkout

All purchases of merchandise and wall art are conducted externally on our Shopify e-commerce platform.

• Redirection to Web Store: The App provides links and navigational buttons that redirect you out of the App environment to our official Shopify-powered website to browse, select, and purchase items.
• Transactions and Payments: Once you leave the App, all transactions, payment processing, and customer fulfillment are handled directly by Shopify's secure web servers in accordance with Shopify's independent terms of service and privacy policies.
• Google Play Policy Compliance: In compliance with Google Play Store Developer Policies, transactions for physical goods and merchandise that occur outside of the App environment on a standard web browser do not utilize or require the Google Play In-App Billing system.

6. Amazon Affiliate and Advertising Disclosures

PawFitter is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites and apps to earn advertising fees by advertising and linking to Amazon.com and affiliated sites.

• Clear Identification: In compliance with Google Play’s Deceptive Ads and Monetization policies, all commercial affiliate links to third-party platforms like Amazon will be clearly and explicitly labeled as sponsored or affiliate links inside the App.
• No Liability for Third-Party Purchases: Any transaction initiated via an Amazon link occurs entirely on Amazon's platform. We do not assume any responsibility or liability for the actions, products, content, or customer service of Amazon or its independent third-party sellers.

7. Intellectual Property Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, AI models, algorithms, text, displays, images, and audio) are owned by Tosh LLC, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property or proprietary rights laws.

8. Disclaimer of Warranties

THE APP AND ALL SERVICES AND PRODUCTS COMPRISED THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TOSH LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

9. Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL TOSH LLC, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE APP.

10. Governing Law

These Terms and any dispute or claim arising out of or related to them shall be governed by and construed in accordance with the internal laws of the State of Arizona, without giving effect to any choice or conflict of law provision. Any legal action or proceeding related to the App shall be brought exclusively in the state or federal courts located in Phoenix, Arizona.

11. Changes to the Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.
